At 12:00 p.m., defendants stormed into the apartment, in plain clothes and had their guns drawn and pointed at plaintiff. Plaintiff was standing in the kitchen and threw himself on the ground for fear of being killed. Plaintiff remained on the ground, facedown, waiting for defendants' instructions. One defendant stood over plaintiff, grabbed his arms, pinned them behind his back, and handcuffed his wrists together with metal cuffs, applying the handcuffs tightly to plaintiff’s wrists. Plaintiff asked defendants to loosen the tight handcuffs, but instead they tightened them, causing more pain. Defendants searched and arrested plaintiff. Defendants took plaintiff to the 83rd Precinct. At the Precinct, defendants took several personal items from plaintiff, and plaintiff was never able recover those items. Defendants transmitted false information to the Brooklyn DA claiming plaintiff illegally possessed weapons and drugs. After several hours, the defendants took plaintiff to Central Booking and charged with Criminal Possession. Plaintiff pled not guilty. The court ordered plaintiff held on $150,000 cash bail—an amount that he was not able to pay. After arraignment plaintiff was taken to Rikers Island. At Rikers, plaintiff was subjected to abhorrent conditions. After five days, plaintiff was released, because the Brooklyn DA failed to secure an indictment within the time limits prescribed by law. At this time, JOHN DOES 1 and 2 arrived at that location in plainclothes and an unmarked NYPD vehicle. JOHN DOES 1 and 2, pulled up alongside PLAINTIFF and one of them said to PLAINTIFF: “Got you!”. They then drove away. At the same time, JOHN DOES 3 and 4 arrived. One of the uniformed DOE DEFENDANTS exited their marked vehicle then placed PLAINTIFF in handcuffs and said to PLAINTIFF, “You just tagged the Department of Health.” . PLAINTIFF was not involved in any activity that would have justified his arrest, and there in fact existed no probable cause to justify PLAINTIFF’s arrest or detention. My name is Maximus Skaff and I am a male.”  This uniformed DOE DEFENDANT, then said to PLAINTIFF: “I only needed one of you to make a point. Because you lied to me about your whole identity, I am just going to rack up the charges.” Plaintiff was then subject to verbal abuse by the Defendant and was moved to a women's holding cell. After several hours he was sent to Central Booking. Plaintiff was again placed in a womens cell. Additionally, at Central Booking, PLAINTIFF was placed in a line to get his mugshot taken. While he was in this line, the photographer, DEFENDANT JOHN DOE 5 loudly stated to PLAINTIFF in front of other arrestees and guards: “since you were born as a female, we have to call you a female.” At Central Booking, DEFENDANTS John Does 6 and 7 placed PLAINTIFF alone in a cell for several hours and where PLAINTIFF was denied medication. PLAINTIFF was then arraigned on a criminal complaint containing false allegations provided by DEFENDANT PEREZ. DEFENDANT PEREZ forwarded these allegations to the Kings County District Attorney’s Office despite the false nature of the allegations.
