Plaintiff purchased a metro card from the machine. She then swiped said card through the turnstile so that her husband could enter via the gate with their stroller and one-year-old daughter. Plaintiff then swiped her card a second time and entered through the turnstile herself. At this point, Defendant officer Warren approached Plaintiff’s husband and asked him whether he had paid for entry. Plaintiff explained that she swiped him in so that he could enter with their stroller. Defendant officer spoke rudely with Plaintiff, but then confirmed with the MTA attendant Plaintiff’s explanation of her husband's entry. Plaintiff and her family continued up the stairs towards the subway platform. At this time, Defendant officer Warren followed Plaintiff and continued to verbally assault her. Plaintiff asked the officer for her badge. In response, Defendant officer Warren shoved her badge in Plaintiff’s face, blocked Plaintiff from continuing up the stairs, and then grabbed plaintiff by the back of her neck and pulled her back down the stairs.
