Someone called 911 and police officers arrived on the scene. Giuliani falsely claimed to the officers that Plaintiff smacked him very hard on the back and his back hurt. Officer Matthew T. McCarthy, at Giuliani's insistence and on orders from Sergeant Milatta, falsely arrested Plaintiff for a violent felony offense without reviewing the video. The false complaint and charge were approved by Officer Michael Levay (who did review the videotape) and Sergeant James Coughlin. Plaintiff was denied a Desk Appearance Ticket by Sergeant Coughlin on the false ground that there was an immediate need for an Order of Protection. The unsustainable charges were downgraded as soon as the video was publicly released.
