At the time plaintiff was legally permitted in the location of the incident and had complained when defendats had ordered him to leave the building. Defendants stood on his arms, knees and neck causing him severe physical and emotional pain/distress. Excessive force was used and other defendants failed to intervene. Excessively tight handcuffs were applied and ignored requests to loosen these. Defendants falsely accused plaintiff of a criminal offence and illegally searched Plaintiff’s person by aggressively shoving their outstretched hands into Plaintiff’s clothing and by rifling through his pockets. Defendants found no contraband or evidence of a criminal offence. He was brought against his will to the precint were he was detained for 7 hours and then to central booking where he was unlawfully detained for a further 18 hours. Plaintiff was unlawfully detained over the course of two days until his release on November 9,2020 and was denied medical attention. Plaintiff asserts defentants were racially discriminatory against hispanic males.
