When Defendant NYPD Officer Joseph Spina, ordered Plaintiff to stop their car and wrongfully touched, grabbed and seized Plaintiff in an excessive manner and caused Plaintiff physical pain and mental suffering. Defendant did not have legal cause to grab, seize or touch Plaintiff. Defendant intentionally falsely accused Plaintiff of having committed the offenses of Excessive Noise and Disorderly Conduct. Defendant intentionally placed Plaintiff under arrest without just cause. On or about April 9, 2016, a traffic summons and criminal court summons were issued at the directive of Defendants and a criminal action against Plaintiff was commenced. Plaintiff was falsely arrested and after the arrest, Plaintiff was detained by Defendants, and he was released on April 9, 2016. On or about April 13, 2016, at approximately 7:30 pm, Plaintiff was operating a motor vehicle in the vicinity of 184th Street and Morris Avenue in Bronx County, when Defendant, Officer John Doe, ordered Plaintiff to stop the car and Defendant wrongfully touched, grabbed and seized Plaintiff in an excessive manner. Defendant falsely arrested Plaintiff without just cause of Plaintiff violating any New York Statute and was then detained and released.  From April 9, 2016 until June 19, 2016, Defendants deliberately and maliciously prosecuted Plaintiff without any cause by filing or causing a criminal complaint to be filed in the Criminal Court of the City of New York, Bronx County. On or about June 19, 2016, Plaintiff made a court appearance during which the criminal summons was terminated in favor of Plaintiff and the charges were dismissed and the records were sealed.
