Officers Antoine and Clinton approached Mr. Bussey and asked if he had caused damage to a nearby bus – Mr. Bussey said no and went on his way. Without any basis, Officers Antoine and Clinton told Mr. Bussey that they wanted him to go to a hospital for evaluation as an Emotionally Disturbed Person but Mr. Bussey refused. Officers Antoine and Clinton then called for police backup and an ambulance – Sergeant Pollari and Officers Tse, Lau, Xia and an ambulance came to the scene. When Mr. Bussey refused to comply with the order to submit to a hospital evaluation, Officers Antoine, Clinton, Tse, Lau, and Xia, under the supervision and instruction of Sergeant Pollari, grabbed Mr. Bussey and attempted to place him in handcuffs. Without warning, Officer Antoine deployed his Conductive Energy Weapon and shot two darts into Mr. Bussey’s back. Mr. Bussey fell onto the ground and he was subsequently handcuffed by the officers and Sergeant Pollari. Mr. Bussey was transported to NYU-Langone Hospital where the darts were removed and the wounds to his back were treated. Mr. Bussey was medicated intravenously against his will and was determined to be neither mentally ill nor a danger to himself or others. Mr. Bussey suffered from permanent scars as a result of the darts.
