Plaintiff and the others were transported, searched and detained, but all of the others were released without charges that day.  Officers initially falsely charged Plaintiff James West as one David West, who had warrants.  Despite Plaintiff James West not being the subject of the search warrant for the premises, he was illegally arrested and charged with criminal possession of narcotics and illegal gambling.  Plaintiff spoke to a Kings County District Attorney and informed them of the mistaken identity, but nothing was done.   The officers and KCDA knew they lacked probable cause and thereafter fabricated evidence that Plaintiff worked on the premises.  Plaintiff was incarcerated until February 28, 2014, when all charges were dropped.
