Defendants did not make a full statement of facts to the District Attorney, withheld exculpatory evidence, and acted with malice in initiating and continuing criminal proceedings against Plaintiff. Defendants were motivated in part by the NYPD's custom of targeting minority males to meet arrest quotas.\n\nPlaintiff was taken to the 25th Precinct for processing, thereafter to Manhattan Central Booking for arraignment, and then to Rikers Island. Plaintiff was incarcerated from December 13, 2014 until December 17, 2014, when he was released from custody. On August 5, 2015, Plaintiff was acquitted of all charges. While at the precinct, plaintiff was unlawfully stripped searched without reasonable suspicion or probable cause.\nSome of the individually named police officer defendants observed the violation of plaintiff’s rights did nothing to prevent it.\n\nThereafter, the officers maliciously prosecuted plaintiff and denied plaintiff a right to a fair trial by initiating a prosecution against him, without probable cause, by falsifying evidence, by providing false, misleading and/or incomplete information to the DA's Office and by signing a Criminal Court complaint which contained false information about plaintiff. They physically seized plaintiffs, pointed weapons at them, forced them to the ground, and forcibly applied handcuffs to them.  The officers kept plaintiffs handcuffed for over three hours.  One of the plaintiffs was naked when the officers entered the apartment and handcuffed her, and the officers compelled her to remain naked.  The officers initiated false criminal charges against plaintiffs, and P.O. Hairston made false statements to the DA in support of those charges.  The officers also initiated a civil action with Child Protective Services against plaintiffs, falsely accusing them of selling drugs in the presence of their granddaughter.  Plaintiffs were required to appear in court on several occasions and undergo interviews and interrogation by CPS.  All criminal charges against plaintiffs were dismissed on the merits on October 6, 2014.  On May 11, 2015, the administrative charges against plaintiffs by CPS were also dismissed. \n\nAgain on February 19, 2016, P.O. Gregory Carty and other officers forcibly entered plaintiffs' residence, forcibly seized plaintiffs, and detained them.  P.O. Carty initiated false criminal charges against one of the plaintiffs in retaliation for plaintiffs having commenced a suit against the City of New York and the officers. The criminal proceeding terminated in favor of plaintiff, as P.O. A man leaving the building held the door open for Mr. Siler, and as Mr. Siler approached the door, a Defendant undercover NYPD officer in plain clothes, who did not identify himself, chased Mr. Siler into the building, up to the roof, and down the fire escape to the building's backyard. Once Mr. Siler reached the backyard, a group of individual defendant officers standing behind a gate shouted at him to get on the ground, while one pointed his gun at him. Mr. Siler lay on the ground. For a few minutes, the defendants tried to figure out how to get around the gate and into the backyard. During this time, they continued shouting at him. This include curses and threats to shoot him if he moved. When one defendant finally reached Mr. Siler, he kicked and stomped Mr. Siler repeatedly in the shoulder, torso, and head, and viciously pulled Mr. Siler's arm behind his back while still applying force to his prone torso. That defendant then handcuffed Mr. Siler behind his back and took him to the front of the building. There, one of the defendants strip searched Mr. Siler, and inserted his fingers into his anus to search his anal cavity. No drugs or contraband were recovered from this search. \nMr. Siler was placed in a police van, where he was kept for about six hours while the police picked up other arrestees. Then, he was taken to a precinct, where he was again strip searched. This search involved an order to Mr. Siler to manipulate his genitals as well as a visual inspection of his anus. At the precinct, Defendant NYPD Detective Harris tried to convince Mr. Siler to confess to selling drugs. After a few hours at the Precinct, Mr. Siler was taken to Central Booking. The DA declined to press charges. Plaintiff was brought before a judge on a separate earlier unresolved charge, which the judge dismissed on the spot, setting Mr. Siler free immediately. Despite the claim that Griffin sold drugs to Ruth Bennette, evidence and timelines provided in court documents and surveillance footage contradicted these allegations. Griffin underwent a humiliating strip search, including a humiliating and degrading strip and visual body cavity search, in which he was forced against his will to take all his clothes off, squat, spread his buttocks and cough. Griffin was brought before a judged and arraigned on a felony complaint which charged him with Criminal Sale of a Controlled Substance in Third Degree, and Criminal Sale of a Controlled Substanced on or NEar School Ground. In the respective complaint, Detective HIller, who was designated as the arresting officer, stated that he was informed by an undercover detective that the latter observed Mr. Griffin and Xavier Jackson \"acting in concert, hand separately charged Ruth Bennette Crack cocaine in exchange for U.S. currency. \n\nOn information and belief, based on the New York District Attorney’s Voluntary Disclosure Form prepared by Assistant District Attorney Craig Ascher, and the questions asked of Mr. Griffin by ADA Ascher in the grand jury, Detective Hiller and/or other of the Individual Defendants told ADA Ascher that they observed Mr. Griffin selling drugs on West 114th Street between Seventh and Eighth Avenues. Any such information implicating Mr. Griffin in the sale of drugs to Ms. Bennette was false. Griffin was arraigned and remained incarcerated until his release on January 18, 2012, with his case dismissed on December 18, 2012.
