The officers ordered the driver to exit the vehicle and subjected him to a search, where they found no illegal contraband. They then alleged that the car smelled like marijuana, even though there was no marijuana in the vehicle, and ordered both occupants to exit the vehicle. Dupigny was video recording the defendants on his cell phone and asked him why they were ordering him to exit the vehicle. They provided no legal reason, but he exited the vehicle regardless. Officers searched him without justification and sexually assaulted him by grabbing his penis, recovering no illegal contraband. The plaintiff verbally expressed displeasure at the assault, and the officers handcuffed and arrested him.\n\nDupigny was transported to the 79th Precinct, where officers grabbed his penis 3 more times. The officers charged plaintiff with Disorderly Conduct and falsely alleged that he “refused to obey a lawful order to have his\nhands visible and repeatedly reached in the vehicle and used offensive/violent language.” The police then intrusively strip searched the plaintiff and served him with a criminal court summons after detaining him for approximately 3 hours.
