Plaintiffs were in a vehicle with two other occupants. The front seat passenger plaintiff was driving to her mother's house when the vehicle was pulled over. At no time did the driving plaintiff commit a VTL or give the officers any excuse to pull him over. The plaintiffs obeyed orders to step outside the vehicle. An officer pulled and dragged on the passenger plaintiff's arm as she stepped out of the vehicle and officer Crespo threw plaintiff against the vehicle. Plaintiff's arm was in serious pain and she requested medical attention. Defendant also asked female officer for help and was ignored. Plaintiff was handcuffed tightly and put in a van. The driver plaintiff was also handcuffed and arrested. Plaintiffs were both transported to the precint. The passenger plaintiff was finally taken to the hospital when she requested medical attention at the precint and was diagnosed with a sprain. Officers provided false and misleading information to the DA office that plaintiffs possessed a firearm. Both had to spend three days on Rikers Island before they could post bail of $15,000 as a result of these false allegations. In November 2022, both cases against each plaintiff were dismissed.
