Burke said he saw plaintiff approaching multiple passerby showing them a CD that the Defendant was holding and that Burke observed 15 people passing on the sidewalk having to walk around the defendant in order to proceed. But this was not true. On April 15, 2013, Defendants took Plaintiff from the 18th Precinct to Manhattan Central Booking where he was detained for many hours. On April 15, 2013 at approximately 2 pm after 24 hours in custody, plaintiff was arraigned in NY county criminal court and was released on his own recognizance.
