Plaintiff was then charged with criminal possession of marijuana in the second degree, criminal possession of marijuana in the third degree, three counts of endangering the welfare of a child, three counts of criminal possession of a weapon in the fourth degree, possession of pistol ammunition, and unlawful possession of marijuana, despite Plaintiff having no guns or drugs int he studio. While in custody, Plaintiff was strip searched. Plaintiff posted bail, but was indicted.\nOn February 3, 2014, a Kings County Criminal Court justice ruled that defendants’ entry into the apartment was unlawful, and therefore contraband recovered from the room identified by the defendants as Virgil’s bedroom was suppressed, as were plaintiff’s statements regarding plaintiff’s residence in the premises.
