Defendant Ward ordered the plaintiff to step outside the vehicle and the plaintiff questioned why he needed to step outside.  Defendant Ward responded by opening the driver's door and forcibly removing plaintiff from the vehicle.  Defendant Ward told plaintiff that he was pulled over because he failed to use a turn signal before turning, despite the plaintiff having used a turn signal and not having violated any traffic laws. Defendant Ward tightly handcuffed plaintiff and then placed him inside the police vehicle, while defendant Doe searched plaintiff's vehicle.  Defendant Doe falsely claimed to have found a \"gravity knife\" inside plaintiff's vehicle.  Then, defendant Doe physically seized and drove off with the vehicle and and defendant Ward transported plaintiff to the 103rd Precinct.  Plaintiff was imprisoned at the 103rd Precinct for several hours, before being transferred to Central Booking, where he remained for over 12 hours. While in defendant Ward's custody, plaintiff repeatedly complained that the handcuffs were too tight and causing him pain; defendant Ward ignored all of plaintiff's complaints.  Plaintiff was subsequently charged with criminal possession of a weapon in the fourth degree and a violation of NY's Vehicle and Traffic Law.  In support of criminal prosecution, defendants Ward and Doe knowingly made false accusations against plaintiff.  Defendant police officer Kipp, Ward and Doe's supervisor, sanctioned the actions of Ward and Doe. A marked NYPD patrol car pulled up, P.O.s Eric Callagy and Robert Miga exited the car and demanded Grant and his companions to freeze. P.O.s had their hands on their revolvers in the ready position. Grant and his companions complied, P.O.s directed grant to put his hands on the wall and an unknown P.O. searched grant, finding nothing. The other P.o. walked to the patrol car and returned moments later. Callagy and Miga handcuffed Grant, when Grant asked why twice, he received no response. On the third time he asked, An officer, it is unknown which one, violently slammed Plantiff’s whole body and face into the wall with such force he fell to the ground. Callagy and Miga proceeded to beat Grant with fists and feet. Other patrol cars arrived, and P.O.s Gary Jacelon, Christopher Latauto, Michael Mitchell, Michael Vila, Thomas O’Brien, Daniel War, Dean Schauder, Bruno Mazza, Gerardo Perrone, and Daniel Gunkelberger were present. Many P.O.s joined in on the assault on grant, pulling out his hair as they pulled him to his feet. Grant was placed in a squad car, and shortly thereafter, pulled from the car and sprayed with a chemical agent aimed directly in his face. Grant was placed back in the car. P.O.s Jacelon and O’Brien were present but did not intervene or truthfully report the use of force. \n\nGrant was taken to the precinct where he was taken from the car and forced to the ground. He was lifted by his handcuffed wrists, then dropped, repeatedly. Someone shouted at the officer to stop. Grant was brought into the precinct and jailed before being taken to the hospital for treatment. Grant was strip searched at the stationhouse. P.O.s prepared false police reports accusing Grant of various crimes.
