Ms. Gonzales was dragged from her bedroom into the living room where the officers further abused the plaintiffs. No contraband was recovered, and the officers falsely arrested the plaintiffs. The plaintiffs were put into a prisoner van and driven around for approximately five hours. Officers misrepresented to the Bronx County District Attorney's Office that the plaintiffs had committed criminal offenses and fabricated police paperwork and documentation including arrest reports. After being held for approximately 42 hours, Gonzalez was released from Bronx Central Booking without seeing a judge, and the DA declined to prosecute her.
