Members of the Department permitted the demonstration to continue without interference as it proceeded – at no time where the demonstrators told to disperse. At approximately 8:30 pm, when the demonstrators were close to the Brooklyn Bridge, the demonstration came to a half – it resumed shortly thereafter and still no order to disperse was given. However, once the demonstration reached the area of Cadman Plaza East and Johnson Street, the demonstrators were confronted by members of the Department – the demonstrators were corralled and pushed by the Department from all directions during which Ms. Costantino heard a member of the Department direct her arrest. In response to this direction, Defendant Said pushed Ms. Costantino onto the ground and placed her wrists in plastic restraints very tightly to the point Ms. Costantino began to cry – she was then pulled up by her restraints and struck in the bridge of her nose by what she believes was Defendant Said’s baton. After this, Defendant Said tightened the plastic restraints even further and Ms. Costantino began to cry again. While she was crying, a member of the Department who Ms. Costantino believed was a supervisor because he was wearing a white shirt told her to remain calm – Ms. Costantino told him that Defendant Said was hurting her and requested a different officer, but was ignored. After her arrest, Ms. Costantino remained in Defendant Said’s presence whilst the other demonstrators were being taken to the bus – when officers asked Defendant Said why Ms. Costantino was not on the bus, Defendant Said aggressively brought her to the bus – he lifted her arms towards her head and Ms. Costantino began crying again. Whilst walking, Ms. Costantino told him that he was hurting her, but Defendant Said ignored her and told her to walk. For unknown reasons, Defendant Said kept Ms. Costantino outside the bus – whilst doing this, Defendant Said repeatedly asked her about information she had relating to the demonstrators. Defendant Said at no point read Ms. Costantino her Miranda warnings. While Ms. Costantino waited outside the bus, she began to lose sensation in her left thumb – she told Defendant Said and requested loosening of the wrist restraints, but he ignored her again. At the holding facility, Ms. Costantino saw Defendant Said in possession of her cell phone, which he attempted to access – he failed to do so because of a passcode. At some point in the arrest processing, Defendant Said tried to remove Ms. Costantino’s restraints – he tried to cut them without success because they were so tightly placed around her wrists. When he was finally able to remove them, Ms. Costantino saw that her wrists had scrapes and were bleeding. The NYPD did not give any orders to disperse. Defendant Police Officer Joseph Ryder suddenly, without warning, grabbed Plaintiff and threw her to the ground. Plaintiff landed on her head and Defendant Ryde and Defendant Police Officers Does #104 pinned Plaintiff's arms and legs to the ground. One Defendant repeatedly slammed Plaintiff's head into the ground, smashing Plaintiff's eyeglasses and scraping her face. Defendants placed a knee on Plaintiff's left ear. These incidents caused Plaintiff's shirt to be dislodged and her breasts were exposed throughout the incident. Plaintiff was arrested and escorted to a bus. On the bus, Plaintiff repeatedly asked Defendant Police Officers Does #5-8 and Defendant Police Officers Said and Moses for medical attention, and the medical worker on the bus also asked Defendants to provide Plaintiff with medical attention but Defendants refused. Plaintiff also asked Defendants to loose her zip ties as they were causing pain and loss of circulation but Defendants refused. During the protest, NYPD Officers suddenly, unprovoked, and without warning, assaulted and arrested protesters. Plaintiff witnessed and recorded with his phone Defendant Sheppard shove a woman to the ground. Plaintiff said \"hey!\" in response but did not otherwise act. Defendant Sheppard immediately turned to Plaintiff and ordered to have him arrested. Defendant Gamble and others attacked Plaintiff from behind, struck his head with a baton, tackled him to the ground injuring his wrist and forehead and cracking his phone screen. Defendants forcefully pressed a knee or elbow into Plaintiff's left shoulder and pressed his face into the ground. Defendants tightly handcuffed him with zip ties that were so tight Plaintiff lost the feeling in his hands. Plaintiff was detained for six hours. Defendants ignored his repeated requests for medical attention or request for a face mask to protect against Covid-19, as his had been knocked off during Defendants assault and arrest of him. Plaintiff was released with summons for violating the New York City curfew despite police giving no order to disperse at the protest.
