Thereafter, Mr. Lewis was handcuffed and placed under arrest by defendants. While being escorted outside of the apartment, Mr. Lewis uttered certain expletives towards the police officers. Upon hearing these remarks, defendant officers then slammed Mr. Nixon into an adjacent wall. Thereafter, P.O. Paolo Bercan punched Mr. Nixon in his face. This assault was witnessed by several members of the New York City Police Department, but none of these officers interceded to stop this unlawful conduct. As a result of P.O.
