He was largely ignored and ultimately ousted from the NYPD for his cooperation with a New York City investigation into the systemic issues with SVD. In January 2017, a NYPD commanding officer made offensive comments that sparked an investigation of the SVD by the New York City Department of Investigation (the \"Department\"). On March 3, 2017, the NYPD held a meeting to prepare for the Department investigation. In attendance were Plaintiff, members of the NYPD Legal Bureau, and Defendant Prunty. During the meeting, Defendant Prunty and other members of the NYPD Legal Bureau instructed Plaintiff to essentially impede the Department's investigation. In subsequent meetings between Plaintiff in the Department, Plaintiff and his staff cooperated with the Department in defiance of Defendant Prunty's instructions. In response, Defendant Prunty threatened Plaintiff's career, specifically if he spoke poorly of CompStat. When the Department sent the NYPD a document request, Defendant Prunty instructed Plaintiff to slow the investigation down and not be fully cooperative. Plaintiff again cooperated fully with the Department, after which Defendant Shea attacking SVD units at weekly CompStat meetings. This pattern continued with subsequent meetings and document requests by the Department, in each instance Plaintiff cooperated fully in defiance of Defendants Prunty and Shea. In January 2018, Plaintiff informed Defendant Monahan that Defendant Prunty was instructing him to impede the Department's investigation.\n\nIn February 2018, Plaintiff was interviewed again by the Department, before which Defendants again threatened his employment if he was candid during the interview. Again Plaintiff testified truthfully to the Department, and as a result of Plaintiff's truthfulness the Department's resultant report negaitvely portrayed the SVD. As a result, Defendants and Plaintiff's colleagues made a number of negative comments and spoke of replacing him. As a result of the Department's investigation, the New York City Council scheduled hearings, for which the Police Commissioner's Office scheduled preparatory meetings including, among others, Plaintiff, Defendant Donahue, and Defendant Spinella, during which Defendants blamed Plaintiff for the Department's negative report. Defendant Shea was promoted to Chief of Detectives, before which the prior chief told Plaintiff that he would have to fight Defendants Shea and De Blasio for his job. Defendants O'Neill, Monahan, Shea, and Essig then conspired to tarnish Plaintiff's reputation, solicit false information about him, and oust him for his cooperation with the Department. The Department conducted a second investigation into the SVD, to which Plaintiff again responded fully and truthfully. In response, Plaintiff was essentially pushed out of his position.
