The officer asked both Plaintiff and the passenger to produce identification. While they told Plaintiff that they did not have a tool to check the tint and he was therefore free to go, they ordered the passenger, Justin Rodriguez, out of the car because they had a warrant out for him. Rodriguez refused to get out of the car, insisting that there was no warrant. As a result, Officer Ryan Smith and three other officers forcibly dragged both Plaintiff and Rodriguez out of the car and handcuffed him. After their removal, Officer Ryan Smith searched the vehicle without consent or a warrant. The officer found a small knife and charged Plaintiff with Criminal Possession of a Weapon in the Fourth Degree for which he was arraigned on August 10, 2017.
