Plaintiff was taken to the hospital where he underwent a 23-hour lifesaving surgery. On or about July 22, 2016, Plaintiff was arrested by Detective Hyram Riffas through excessive force, without probable cause. Plaintiff was charged with various offenses relating to possession of weapons in relation to the incident on June 13, 2016, despite the NYPD and Detective Riffas knowing Plaintiff had not committed the crime in question and was the victim of the shooting. While in custody at the precinct, Plaintiff was subjected to violence and denied necessary medical care required for his serious injuries. Plaintiff was incarcerated for approximately 92 days at Rikers Island (July 22, 2016 - October 22, 2016) and was maliciously prosecuted based on specious false and non-existent information. On April 4, 2017, all charges were dismissed.
