Despite the boyfriend screaming in pain and informing the officers they were breaking his finger, the assault continued.\n\nThe plaintiff, witnessing the injury, attempted to record the incident on her cell phone. One officer shouted, “Get this bitch out of here!” referring to the plaintiff. Officer Mastranardi then ordered, “lock this stupid bitch up,” and instructed Officer Billy Joseph, Shield # 2565, who had just arrived and was unaware of prior events, to arrest the plaintiff. Officer Joseph falsely arrested the plaintiff without probable cause, handcuffed her, and placed her in the back of a police vehicle. She was charged with assault with intent to cause physical injury, despite the allegations being fabricated and insufficient to support the charges.\n\nThe plaintiff was taken to the 83rd Precinct, where she was unlawfully searched, fingerprinted, photographed, and detained in a holding cell. While in the cell, the plaintiff became extremely upset, yelling, crying, and repeatedly banging her head against the wall, resulting in a severe headache. She required a CAT scan at the hospital.
