Officers thereafter also placed Plaintiff 2 under arrest. \n\nPlaintiff 1 was charged with disorderly conduct, resisting arrest and harassment. He was held in police custody until his arraignment approximately 24 hours later. All charges against plaintiff Plaintiff 1 related to this incident were later dismissed. Plaintiff 2 was held at the police precinct for several hours before being given a summons ticket and released. All charges against Plaintiff 2 related to this incident were later dismissed. NYPD Officer Robert Carrozzo suddenly arrived and demanded to know what Mr. Dryden was doing there. Mr. Dryden explained to NYPD Officer Robert Carrozzo why he was there and presented valid identification, Officer Carrozzo placed Mr. Dryden under arrest for no reason. Mr. Dryden was then taken to the 79th Precinct, and was kept there for 9 hours. He was then taken to Central Booking, and was there for 16 hours before seeing a judge. Mr. Dryden was arraigned on Kings County Docket and was informed that he had been charged with Criminal Trespass and Attempted Burglary. After attending Court for more than one year, the criminal charges were dismissed on July 31, 2013. \n\nOn September 11, 2012, Mr. Dryden was lawfully outside the same property, where he was acting as the property manager, repairing the fence. NYPD Officers Robert Nelson and Andrew Ho arrived in an unmarked vehicle. Te officers exited with their weapons drawn and began flipping the garbage can lids. The officers continued to illegally search the property. Officer Nelson said that if Mr. Dryden provided him with some information, they could cut him some slack. Mr. Dryden declined because he had no information to provide. Angered, Officer Nelson approached Mr. Dryden. He showed Mr. Dryden an empty Newport cigarette box he claimed to have found in the backyard of the property, and then arrested him under the false premise that Mr. Dryden had had possessed a controlled substance. The officers also caused Mr. Dryden to be charged with Consumption of Alcohol on the Streets, despite never observing him drinking alcohol. Mr. Dryden was taken to the 79th Precinct, processed and then transported to Brooklyn Central Booking. At the criminal court arraignment, Mr. Dryden learned that he was charged with Criminal Possession of a Controlled Substance in the 7th Degree and Consumption of Alcohol on the Streets. \n\nAt the criminal court arraignment, Mr. Dryden was arraigned and bail was set at $1,000.00. As he was unable to post bail, he was taken to Riker's Island. He remained confined there for more than four months (approximately 133 days).
