The Officers unlawfully assaulted, intimidated, threatened, handcuffed, arrested and incarcerated Plaintiff without just or probable cause. Plaintiff subsequently learned he was charged with stealing a car and robbing an individual at gunpoint. Plaintiff was arraigned, pled not guilty and remained incarcerated for 5 days before he was released. However, on August 14, 2013 Plaintiff was walking through a housing project where he resides and was harassed, chided, threatened and cursed by the same Officers. Later, on or about September 17, 2013, and after the charges relating to the stolen car were dismissed, Plaintiff was charged with probation/parole violation which caused him to be reincarcerated from September 17, 2013 to March 28, 2014, despite Plaintiff not doing anything to violate his probation/parole. Plaintiff believes such arrest was a retaliatory arrest. It later came known that the officers had video image evidence which exonerated Plaintiff, depicting the actual perpetrators of the crime who did not resemble Plaintiff. On January 29, 2016, all charges against Plaintiff were dismissed.
