He did not threaten the officer but did say to write him back or to call to discuss. In retaliation, Moglia's colleagues got a search warrant from the DA under false pretenses. Police then raided plaintiff's apartment and sized computers and phones. Officers used excessive force and dislocated plaintiff's left shoulder. Officer Buehler then charged with plaintiff with aggravated harassment in which Moglia said the email placed him in fear of serious injury. The DA used this to make the search warrant. \nPlaintiff was arrested after the search and spent 12 hours in jail before being released. Her husband said that Plaintiff said that if he tried to divorce her, she would kill him. Plaintiff denied making such a statement, showed texts that described that she was in fact leaving her husband because of his emotional abuse, and explained that his statement was in retaliation to her leaving. Plaintiff provided witnesses to corroborate her story, but Detective Pereira failed to conduct a meaningful investigation with them and instead arrested Plaintiff without probable cause. Plaintiff was incarcerated for 33 hours, and her criminal case was dismissed in her favor eventually. On July 21st, 2012, three police officers arrived at Plaintiff's residence and arrested Plaintiff, taking her to the 68th precinct. Plaintiff's husband had told the police that some identified man had called him from a blocked number the day before and he had heard Plaintiff screaming in the background that if he tried to divorce her, Plaintiff would blow up his car. Plaintiff had denied these allegations and said she was at a concert the day before. Police officer Natal arrested Plaintiff regardless, and she spent three days incarcerated in Riker's Island as a result. When she was released, she noticed that her husband and his cousin had been waiting for her. Nobody helped Plaintiff despite her requesting assistance. On July 29th, 2012, Plaintiff's husband jumped out in front of her on the street and accused her of cheating on him. Plaintiff called the police and told them upon arrival that her husband had an order of protection against her, and would not keep his distance in an effort to make it seem as though she was violating her own order of protection. The police took no action, despite there being video evidence available.
