One of their daughters began suffering from an asthma attack and didn’t respond to her medication. Plaintiffs drove to the hospital, attempting to get their daughter there as quickly as possible. Plaintiffs were pulled over by an NYPD officer, Alfonso Mendez. Plaintiffs asked Officer Mendez to perform CPR on their daughter, but he claimed to know know how. Plaintiffs then asked for an emergency escort service, which was ignored. Officer Mendez did not radio for help. Ultimately Officer Mendez did agree to an escort, but he drove behind Plaintiffs which made the situation look like a car chase.
