Upon information and belief, the arresting officers were PO Brian D. O’Hanlon and John Doe 1 (the name John Doe is fictitious, as the true name of the second officer was unknown at the time of the complaint). The NYPD then produced documents related to Plaintiff’s arrest, which included Plaintiff’s full name, his correct date of birth, and an accurate physical description of him as a white male with a certain length and weight. The documentation also showed that the police had searched for warrants for Plaintiff and found none. \n\nHowever, while Plaintiff was at the precinct, PO Doris Lopez told Plaintiff that he had a Kings County warrant for murder, although that warrant was for a man with a completely different name; that other man appeared in a police mug shot as a black man with dreads. POs O’Hanlon and John Doe 1 questioned Plaintiff about the warrant. Plaintiff explained that he had been mistakenly detained on the basis of that warrant, issued for another person, twice before. Nevertheless, NYPD proceeded with the case and Plaintiff was arraigned and then detained at Riker’s Island between September 1 and September 7 or 8, 2011. While detained, Plaintiff was denied necessary medical treatment for his serious medical needs. On September 7, 2011, when Plaintiff once again appeared in court, the ADA stated on the record that Plaintiff was not the defendant and that Plaintiff’s personal information did not match the information on the warrant and that it was obvious that Plaintiff did not look like the person in the mugshot. The ADA also noted that the NYPD repeatedly had arrested Plaintiff instead of the person for whom the warrant had been issued.
