Plaintiff peacefully complied with the officers’ orders. Defendants then handcuffed Plaintiff, slammed Plaintiff’s head onto the hood of their police car, emptied Plaintiff’s pockets, and retrieved Plaintiff’s identification and $20 in cash, all without permission or authority. At no time during or subsequent to his arrest was Plaintiff read his Miranda rights. Plaintiff was then transported to the precinct for processing, where he was informed that the reason for his arrest was because he allegedly sold drugs to Michael Harding, a friend of the Plaintiff and a man whom the Plaintiff handed a cigarette to shortly before his arrest. Plaintiff denied ever having sold Mr. Harding any drugs, and Mr. Harding corroborated Plaintiff’s story. Nevertheless, at the precinct, Plaintiff was forcefully strip-searched in an open area—that is, made to strip naked, bend over, squat, and cough in front of strangers not participating in the search—and was charged with criminal drug possession with intent to sell and criminal sale of a controlled substance—both felonies—as well as criminal possession of a controlled substance—a misdemeanor. Plaintiff did not have the means to afford bail, so he was forced to endure 14 days of incarceration at Riker’s Island. On or about February 8, 2012, the felonies were dropped, as there was no evidence to suggest Plaintiff had ever possessed or sold any narcotics.
