A rival security member was identified as the shooter, injuring two security personnel. Surveillance footage captured the incident, clearly showing that Fennell was not involved in the shooting. Despite this, on March 6, 2016, NYPD Detectives Jeffrey Meenagh and Richard Simplicio, along with Sergeant Michael J. Lopuzzo, arrested Fennell and charged him with attempted murder, assault, and criminal possession of a weapon. Security footage was edited to falsely imply his involvement, and DNA evidence, available by August 9, 2016, did not match Fennell. He remained in custody until just before trial in April 2017, when his defense attorney presented the complete, unedited footage to the Bronx District Attorney.
