Mr. Salvatore Mazzio and Mike’s Heavy Duty Towing, Inc., obtained consent of Western Express to remove the Truck. Whilst at the scene of the crash, Mr. Salvatore Mazzio had a discussion with Officer Minutolo about the situation. Despite learning of the circumstances behind Mr. Salvatore Mazzio’s presence, Officer Minutolo nonetheless recommended employees of Western Express to file a criminal complaint against Mr. Salvatore Mazzio and Mike’s Heavy Duty Towing for extortion. Detective Garcia spoke with the Queens County District Attorney’s office and told the attorneys, baselessly, that Mike’s Heavy Duty Towing was associated with organized crime. All this was in spite of the fact that an invoice for the services provided (in the amount of $12,374.73) was delivered to Western Express and communications on and before July 8 indicated that Western Express had expressly requested Mike’s Heavy Duty Towing, Inc. to remove the truck.
