POs did not find any contraband from unlawful search. POs refused Plaintiff’s requests to provide him with medical care or attention. Because the POs falsely provided information, the Plaintiff was falsely prosecuted. Jennings was at her home 184-19 Henderson Avenue at Queens. Jennings was taking a refuge from her abusive uncle when the officers warrantlessly removed Jennings from her home with threats of violence, lifted and slammed her onto an EMS stretcher-including slamming her head against metal siderails of the stretcher, arrested and detained her while assaulting her verbally and physically. She was hit, struck, kicked, and punched, resulting in many injuries on her face. Jennings subsequently lost consciousness and was transported to a hospital. Jennings was then charged with a crime that both the officers and she knew Jennings did not commit, but the officers continued to prosecute Jennings. The officers maliciously charged Jennings with assaulting her uncle when in reality it was the uncle assaulting Jennings. The officers did not exercise due diligence in ascertaining the truth, including questioning the witness. While being detained, Jennings was not notified of her Miranda rights nor had access to a lawyer within 12 hours. Consequently, Jennings suffered from reputational harm, physical injury on multiple parts of her body, mental distress.
