Plaintiff’s girlfriend and friend stepped back to the corner and called police. The altercation lasted 10 minutes before Defendants arrived. Defendants contorted Plaintiff’s arms behind his back and affixed metal handcuffs in a tight fashion. Plaintiff requested Defendants loosen the handcuffs, but defendants ignored Plaintiff’s pleas, as well as request for medical attention for his bleeding lip and hands. While Mr. Morse was out of his vehicle filming Police activity, he was told by the defendant police officers to stop filming. Mr. Morse responded that it was his right to do so. He was then tackled to the ground by the officers sustaining personal injuries. The defendant officers then proceeded to give Mr. Morse a traffic ticket, used physical force against him by tackling him to the ground, which was unnecessary and unjustified. The officers then searched Mr. Morse without his consent and without reasonable suspicion, probable cause or other justification. The officers also forcibly handcuffed and arrested Mr. Morse and thereafter kept him imprisoned at various locations, including a police precinct and Central Booking, without a warrant and without probable cause. \n\nOn or about April 24, 2022, the defendant officers also caused Mr. Morse to be maliciously prosecuted, causing him to be charged with crimes of which he was innocent, and of which the officers knew they would not prevail at trial because the\ncharges were false. Mr. Morse was incarcerated for a period of approximately 24 hours. Thereafter, on or about April 25, 2022 the plaintiff was notified that the New York County District Attorney's Office had declined to prosecute charges against him.
