Defendants (Police Officers) arrived later.  Defendants did a hasty investigation without talking with all the people involved in the incident and the key witness.  They ignored the bruises on the Plaintiff as a result of the incident and ignored her statements that she was the victim.  Nor did Defendants get an interpreter despite the fact that some people involved in the incident did not speak English at all (e.g., the ex-in-laws) or did not speak English very well (e.g., Plaintiff).  One of the Defendants, Vasquez, made a call  that Plaintiff was a perpetrator and restrained and arrested Plaintiff in a baseless arrest.  Vasquez (male) took ahold of Plaintiff (female)’s arm into the elevator despite the fact that Plaintiff is handcuffed (by P.O. Vasquez) and was already held by two female cops.\n\nIn the precinct, Plaintiff interacted with Defendant Gigante, who, in sum and substance said to Plaintiff: “We know you didn’t do anything, but once we ‘cuff you, we have to arrest you and take you in.”  Defendant Gigante also told Plaintiff that she was “sorry” many times, both at the time of arrest, then in the police station and then when Plaintiff was taken outside to a police car to be taken to the Kew Gardens Courthouse for arraignment.  Defendant Gigante also said more than once that Plaintiff could sue the City for what had happened to her and she would get “a lot of money.”\n\nSince this incident, Plaintiff is very afraid now of the police. She has problems sleeping and is very nervous as a result. The Plaintiff's friend was arrested. A second friend of the plaintiff existed the station and asked the police where the arrestee was to be taken. When the police were aggressive in response, the Plaintiff tried to diffuse the situation. The plaintiff was walking away with his second friend when the police began yelling at him. When the plaintiff asked the police to take it easy, he was arrested  without probable cause or reasonable suspicion by several officers including Defendant ANA D. CUAZ  (Shield # 29104). During the plaintiff's arrest, several police officers including Defendant Cuaz and Defendant P.O. YAUDY FERNANDEZ (Shield #3894) punched the plaintiff in the face causing bruising, swelling and broken blood vessels in the eye. The assault continued while the plaintiff was on the ground. Defendant Officers CHRISTOPHER GARCIA (Shield # 6086) and P.O. PETER THALL (Shield # 1665) witnessed the attack and failed to intervene. The plaintiff was transported to the precinct where the Defendants generated an arrest report including false allegations of criminal activity. The Plaintiff was held overnight prior to arraignment.
