Plaintiff returned the next day and handed the attendant his claim ticket only to be told that Plaintiff had already driven it away. Plaintiff insisted it was not him and asked to review the video surveillance but the camera was not in operation. Plaintiff then called 911 and two unnamed POs responded. Plaintiff explained the situation and a person who identified himself as the owner spoke to the police urged them to speak with a detective the owner had already contacted. The POs took the owner and Plaintiff to the 44th Precinct. There they were met by Det. David Cruz, who took Plaintiff upstairs alone. Det. Cruz asked Plaintiff for the claim ticket, which Plaintiff provided and Det. Cruz pocketed. Plaintiff asked to file a stolen car report and Det. Cruz told him that required registration and insurance papers. \n\nPlaintiff procured the paperwork and returned to the precinct approximately one-half hour later but was forced to wait in the lobby for up to eight hours to see Det. Cruz, eventually learning Det. had left around midnight. POs told Plaintiff to return to the lot and call 911 in order to file a report, which Plaintiff did. Plaintiff then returned to the precinct to retrieve the claim ticket and told Det. Cruz he had filed a stolen car report. Det. Cruz became angry and falsely arrested and imprisoned Plaintiff. Plaintiff was kept overnight and denied water and food. Plaintiff was charged the next day with Falsely Reporting an Incident. Plaintiff was compelled to return to court numerous times to defend against the false charges until he was acquitted on June 10, 2013. The stolen car was eventually located and had sustained significant damage.
