After checking the identifications and asking several questions, Plaintiff was issued a ticket for driving through a red light. Plaintiff and his wife then drove away. Approximately one block later, officers pulled him over again. They approached Plaintiff's car with their guns drawn. Plaintiff was violently pulled from the driver's seat and assaulted by the officers. He was dragged, punched and kicked multiple times. He was struck several times with a police baton. Plaintiff was taken to the precinct handcuffed despite having committed no crime. He was then taken to the hospital where he was diagnosed with a facial fracture, abrasions to his face, arm, upper lip and lower left back. After he received treatment, he was taken back to the precinct, where he began to feel dizzy and collapsed into the bars of the jail cell. EMS transported him back to the hospital, where he was diagnosed with swelling to the top of his head. Plaintiff was charged with Assault in the Second Degree and other related charges. Eleven months later, all charges against Plaintiff were dismissed.
