At about 2:00 a.m., a group of police officers, including Sabella, Chau, Singh, Triolo, Steiger, O'Brian, Modesto, Ortega, Becker, Villafone, and Chan, entered the home without a warrant and remained therein over the landlord's objections. The defendant officers proceeded to arrest plaintiffs without any probable cause. At the station house, defendant Matthew Sabella created arrest paperwork in which he claimed that he had observed the plaintiffs committing various crimes, though defendants at no time witnessed the plaintiffs commit any crimes. Plaintiffs were eventually transported to Kings Central Booking. Officers immediately grabbed one of the Plaintiffs, banged his head against a wall, and then threw him to the floor. One of the officers thereafter placed one of his feet on the head of Plaintiff, applying excessive and unnecessary pressure to his head with an intent to injure him. That Plaintiff was subsequently thrown on a bed, where he, including his private parts, were searched in full view of other officers. Meanwhile, the other Plaintiff was grabbed off the chair where he was sitting and thrown on the floor, where he remained until officers searched and handcuffed him. The Plaintiffs were taken to the precinct and Central Booking, where they were held for several hours, before they were released without any explanation as to why they had been arrested in the first place. \n\nOfficers forwarded false allegations about the arrest to the DA’s Office. Upon information and belief, Plaintiffs were released only after the DA’s Office declined to prosecute Plaintiffs based upon the lack of probable cause that existed for the arrest or prosecution of Plaintiffs.
