While there, he asked a bystander for a light for a smoke, and then proceeded to smoke a cigarette. He begun to walk away when P.O. Daniel Fitzpatrick and Sgt. Kenneth Monahan approached and placed him up against the wall and begun to pat him down. They handcuffed him, and told plaintiff to \"shut the fuck up, you know what you did\" when he asked what was happening. A black unmarked police van pulled up and plaintiff was arrested and taken to the precinct. At the precinct, plaintiff again asked what he was being arrested for and P.O. Fitzpatrick told him \"promoting prostitution.\" Plaintiff was charged for promoting prostitution. Officers Fitzpatrick and Monahan gave false reports to the DA's office to substantiate the crime.
