Without probable cause, Plaintiff was accosted, searched, tightly placed into handcuffs, and arrested by NYPD Officer Marc Lebron and several unidentified NYPD officers. Plaintiff was transported to the precinct, where he was charged with several crimes. The officer submitted false information to the Kings County District Attorney’s Office, on the basis of which a prosecution against Plaintiff was initiated. Plaintiff spent approximately 22 hours in police custody and had to make approximately 4 court appearances. On October 29, 2014, some of the charges were dismissed in their entirety. Defendant Officers Mosca, LeBron, O'Brian and Fischer then falsely accused Plaintiff of selling drugs and without reasonable suspicion dragged him out of the car and subsequently searched him and the vehicle without finding neither contraband nor evidence of any crime. Defendant Officers then placed the Plaintiff under arrest despite the lack of any probable cause. At the precinct, Defendant Officers falsely informed the District Attorney's Office that they had observed the Plaintiff selling marijuana. The video footage of the NYPD camera in the location where the Plaintiff had allegedly sold marijuana was never released to the Plaintiff's attorney despite several requests to do so. As a consequence of these actions by Defendant Officers, Plaintiff was arraigned and had to endure almost a dozen court appearances over the course of 15 months.
