Forcing him to return into the store, the officers advanced towards the Plaintiff with loaded firearms, extended limbs, and other items they used violently to catch, subdue, and arrest him, even though the Plaintiff was not resisting. The handcuffs were placed on the Plaintiff’s wrists so tightly that his wrists turned red and swelled up. At the time of the arrest, the Plaintiff was not given any explanation as to why he was being arrested, and the officers had no warrant or probable cause. Defendants Detective Michael Smith and Officer Gerson Cabrera, whose statements Detective Smith claimed he relied on to make an arrest, falsely claimed that Officer Gerson Cabrera had witnessed the Plaintiff participating in a drug transaction. The false statements of the Defendants were used to justify the search, jailing, and charging of the Plaintiff for a crime he did not commit. After Plaintiff was arrested, he was subjected to two strip searches and cavity inspections, even though there was no contraband found on him and there was no legal cause to commit such searches. In addition to physical injuries caused by the violent arrest, for which the Plaintiff was denied prompt medical care, the Plaintiff endured humiliation and sustained severe and permanent psychological injuries.
