While walking back, plaintiff was confronted by another group of 4 or 5 officers. Unprovoked, one doe officer picked plaintiff up by his backpack and slammed plaintiff into the concrete headfirst. The doe officers assaulted and handcuffed plaintiff while he was on the ground. While plaintiff was handcuffed, some doe officers punched plaintiff in the face and head while other doe officers sat on top of plaintiff. Plaintiff was arrested and charged with one or more violations of New York State Penal Law. Defendant Officers Daniel Tooma and William Helbok falsified records submitted to the New York DA's office causing plaintiff to be charged with third-degree attempted burglary and fourth-degree criminal mischief.
