Defendants broke down the door, entered the apartment with shields and helmets, and drew their firearms at plaintiffs and their minor children, and placed plaintiff's 12 year old daughter in handcuffs. Plaintiffs were not free to disregard defendants' questions, walk away or leave the scene. Defendants grabbed plaintiff Aponte while in her nightgown, shoved her against a wall, twisted her arms and placed excessively tight handcuffs on her wrists. Defendants witnessed these acts, but failed to protect plaintiff from the conduct. Defendants searched Aponte but found no evidence of contraband. Defendants grabbed plaintiff Calderon while in his underwear, threw him to the ground, a defendant placed a knee in his neck, then twisted Calderon's arms and placed excessively tight handcuffs on his wrists. Defendants witnessed these acts, but failed to protect plaintiff from this conduct. Defendants searched Calderon and found no evidence of contraband. While searching the apartment, defendants damaged plaintiffs' personal property, furniture and fixtures. Defendants stole and converted plaintiffs' personal property, including jewelry, and a laptop computer. Defendants arrested and transported plaintiffs to the 25th precinct, then to Manhattan Central Booking. Defendants told the New York DA plaintiffs committed a crime. Based on these allegations the DA initiated a prosecution against plaintiffs. The NYC ACS took plaintiffs' minor children and initiated a case. After arraignment, Calderon was held for 5 days until bail was posted. On September 28, 2012, Calderon's prosecution was dismissed in its entirety.
