POs illegally searched Plaintiff by aggressively shoving their hands into her clothing and personal belongings but no contraband was recovered. Regardless, PO Philbert grabbed Plaintiff's arms and violently affixed too-tight handcuffs to her wrists. Plaintiff was illegally taken to the 78th Precinct then Central Booking, and was ultimately detained for approximately 9 hours. Plaintiff was maliciously prosecuted but all charges were ultimately dismissed. Plaintiff suffered substantial physical and emotional injuries as a result of this incident.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=B77rb5Ctd6yHKOvqmhW9EQ==","type":"complaint"}]},{"name":"Province, Jerry vs City of Ny, et al.","start_date":"2022-03-16","disposition_date":"2024-08-22","payout_amount":20000,"disposition":"Settlement","docket":"529424/2021","court":"Supreme Court - Kings","summary":"On March 18th, 2018, at approximately 1:30 pm, inside 139 Flatbush Avenue, Brooklyn, NY,  Defendants NYPD police officers, detectives, sergeants, lieutenants,  Clinton Philbert, Shapiro Lecorps, and John or Jane Doe 1-10 approached Plaintiff Jerry Province in a threatening and aggressive manner. Defendants did not have a lawful reason to approach, stop, seize, or arrest the Plaintiff because they did not observe him commiting any crimes, violating the law, or get any information from any witnesses indicating that the Plaintiff participated in criminal activity. The Defendants then violently tackled the Plaintiff to the ground, punched him, and struck him with various unknown objects on his body, face, head, legs, and arms despite the Plaintiff being unarmed and not resisting the officers' actions. Defendants then forcibly tightly handcuffed Plaintiff's wrists and then violently punched, kicked, and struck Plaintiff again as he was defenselessly pinned down facing the ground and handcuffed. As a result of the Defendants' actions, the Plaintiffs suffered substantial physical pain and injuries such as lacerations, contusions, hematomas, and loss of overall movement that caused the Defendants to get the Plaintiff's medical treatment at Kings County Hospital. After receiving medical treatment, Defendants transferred the Plaintiff to the 78th Precinct where he was subjected to an unlawful strip search and attendant cavity inspection by the Defendants. \n\nDefendants then forwarded fabricated evidence stating that the Plaintiff was resisting arrest and trespassing to the Kings County prosecutors so criminal charges could be initiated against the Plaintiff, despite there being no lawful reason to stop, arrest, or use the level of force they did on the Plaintiff.  Plaintiff was ultimately deprived of liberty and freedom of movement because he remained in the Defendants' physical custody or was subject to their restrictions until the dismissal of Plaintiff's charges on April 23rd, 2018. Plaintiff believes that the Defendants committed the illegal acts against him solely because of his race. Ultimately, the Defendants' actions caused Plaintiff to suffer loss of his liberty, irreparable reputational harm, loss of earnings and potential earnings, substantial and permanent physical and psychological injuries, fear, embarrassment, humiliation, traumatization, frustration, extreme inconvenience, and anxiety.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=bhSbIs3S6up7cXchpKo7Vg==","type":"complaint"}]}],"discipline":[{"disposition_date":"2015-11-30","case_no":"2015-14793","penalty":"Vacation days (10 days)","charges":[{"desc":"Wrongfully and without just cause engaged in off-duty employment without authority or permission to do so.","disposition":"Guilty"}]},{"case_no":"2011-3604","disposition_date":"2012-01-10","penalty":"Forfeiture of fifteen (15) vacation days","opened_date":"2011-04-25","charges":[{"desc":"Failed to remain on post","disposition":"Guilty"},{"desc":"Wrongfully received a twin mattress from a mattress store free of charge and failed to notify Department prior to accepting said mattress","disposition":"Guilty"}],"documents":[{"name":"Document","url":"https://www.documentcloud.org/documents/4418890-nypd-cases-527.html"}]}],"documents":[{"url":"https://www.documentcloud.org/documents/24441170-bronx-notified-officers-list-edited_redacted-redacted_redacted","type":"credibility-finding"}],"image":"https://www.50-a.org/images/officer/QEV-clinton-philbert.jpg","payroll":{"salary":"119248","regular":"112751","overtime":"42144","other":"21675","total":"176570"},"id":"QEV","url":"https://www.50-a.org/officer/QEV"}
