Defendant Officers Marco Alzate, (Shield No. 16914), Anthony Anglisano, Tony Antira (Shield No. 6448), John Blanco (Shield No. 3627), Joseph Chon (Shield No. 12320), Yubelca Fernandez, Larry Meyers (Shield No. 29486); Andrew Shon (Shield No. 22842), and Denise Vega were police officers of the NYPD, acting in the capacity of agents, servants, and employees of defendant City, and within the scope of their employment as such on November 1, 2011. William Gardner was a Captain in the NYPD who is also a named defendant and was present when the incident occurred. After the rally, the plaintiffs and others proceeded to the NYPD’s 73rd Precinct, where they lawfully gathered on the sidewalk in front of the building to protest the NYPD’s stop and frisk practices. Captain Gardner ordered the above-named defendant police officers to arrest the above-named plaintiffs. Plaintiffs were handcuffed and transported to the 75th precinct, held for several hours and made to return to court for various appearances. As part of a continuing art project, Plaintiff’s truck was painted to suggest, satirically, an association with the WikiLeaks entity. Plaintiffs were stopped, pulled over, and arrested without cause by Defendant Police Officers. Following the arrest, Defendant Police Officers detained Plaintiff McGregor for approximately six hours. Following approximately three appearances in court, all charges against Plaintiff McGregor were dismissed. Defendant Police Officers later detained Plaintiff Stoeckley for approximately thirty hours. Following multiple appearances in New York traffic, summons, and criminal court, all charges against Plaintiff Stoeckley were dismissed. Defendant PO Vincent Boccio later offered false information to Plaintiff Stoeckley in regard to the location of his truck following his arrest.
