Plaintiff remained inside the hotel, rear cuffed, while members of the NYCPD including defendant officer Gregery Chardonet spoke with residences of the hotel. 30 minutes later, police offers removed the handcuffs from Plaintiff and ordered him not to return to the hotel that night.\n\nAfter Plaintiff left the Washington Hotel, his lawful place of resident, Plaintiff realized he forgot his coat, so he returned to the hotel and asked a uniform police officer if he could retrieve the coat, but did not want to be arrested for returning to the hotel. The officer then escorted the Plaintiff upstairs to retrieve the coat, where he seen by other officers, including Defendant Officer Chardonet. Defendant Chardonet then placed Plaintiff under arrest for Assault and Harassment. Plaintiff was transported to 25th precinct for arraignment, and then released on his own recognizance.
