Defendants Pliwiak, Zerella, Santana, Tasevoli, Mastorardi, Calhoun, Elliot, McSherry, Lt. Cain, and John Does #1-5 conducted a search and investigated in response to the robbery. Throughout the search, Defendants found a quantity of Marijuana in the third-floor apartment. Plaintiff was the owner of the property, but the Marijuana was discovered in an apartment that had recently been rented and occupied by an unrelated tenant. Despite Plaintiff's limited access to the apartment, defendants, including but not limited to Detectives Santana, Tasevoli, and Mastorardi, made flagrantly racist and discriminatory remarks to Plaintiff in their line of questioning. Said Defendants then attempted to coerce Plaintiff into signing a search warrant. One Defendant Officer then tried to physically intimate and coerce Plaintiff into signing the warrant, and upon Plaintiff's second refusal, the ranking defendant officer instructed Defendant PO Pliwiak to handcuff and arrest Plaintiff. Plaintiff was held for 55 hours at the Precinct and, as a result of his charges, lost his job and his FINRA (Financial Industry Regulatory Authority) permit.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.460145/gov.uscourts.nyed.460145.25.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/59674441/chowdhury-v-the-city-of-new-york/"},{"name":"Ortiz, Cammi vs Ardolino, Michael, et al.","start_date":"2019-02-26","disposition_date":"2025-08-07","payout_amount":105000,"disposition":"Settlement","docket":"19CV00069","court":"U.S. District Court - Eastern District NY","summary":"On May 10, 2017, Officer Michael Ardolino, Officer Daniel Gerardi, Sergeant Gary Calhoun, and other unidentified officers went to an apartment to execute an arrest warrant against Ms. Ortiz' boyfriend, William Wright. Mr. Wright stepped into the hallway to surrender, and Officers Ardolino and Gerardi, Sergeant Calhoun, and other unidentified officers entered the apartment without a warrant and found plaintiff, Cammi Ortiz, asleep. The defendants awakened Ms. Ortiz and arrested her, reporting to the District Attorney that they found her in possession of drugs and other contraband. The defendants also made reports to various media outlets that led to stories being written in newspapers and broadcasted on the news that Ms. Ortiz was dealing drugs with members of the Pink Houses criminal enterprise. The charges against Ms. Ortiz were dismissed and sealed in large part due to a Facebook live video from a bystander that revealed the defendants' reporting of the facts to be false. This video was only available for Ms. Ortiz' defense because it had been uploaded to Facebook live; the defendants had seized the telephone on which the recording was made and deleted the recording from the phone.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.427586/gov.uscourts.nyed.427586.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/8502099/ortiz-v-ardolino/"},{"name":"Clarke, Diakel vs City of New York, et al.","start_date":"2018-12-26","disposition_date":"2019-07-11","payout_amount":17500,"disposition":"Settlement","docket":"18CV07300","court":"U.S. District Court - Eastern District NY","officer_name":"Calhoun, Gary M.","summary":"On May 1, 2016, plaintiff Diakel Clarke was inside of a Brooklyn residence to purchase commemorative candles for his grandfather.
