Plaintiff stepped inside of his vehicle, intending to retreat from aforesaid verbal dispute, then Ms. Negron abruptly inserted her head into Plaintiff’s vehicle while Plaintiff was closing his car door.  Plaintiff unintentionally hit Ms. Negron with his car door while he was closing it causing her nose to begin hemorrhaging. Defendants instructed Plaintiff to put his hands up in the air without having reasonable suspicion or probable cause that Plaintiff had committed a crime and were not informed by any witnesses of such, to which the plaintiff immediately complied. Defendants violently threw Plaintiff onto the ground despite Plaintiff’s clear indications that was not resisting Defendants’ instructions. Defendants proceeded to physically restrain Plaintiff while violently contorting his arms behind his back before finally affixing metal handcuffs to Plaintiff’s wrists in an excessively tight fashion. Defendants began repetitively kicking and punching Plaintiff throughout his entire body that caused him to be transported to Lincoln Hospital due to injuries. Plaintiff was then caused to be forcibly removed against his will by defendants to the 41st Precinct.
