Later that night, the Plaintiff came across officers Philbin and Gregory Rittenhouse at Jeremy's. The officers, who were highly inebriated, asked for a ride back on the Plaintiff's boat and the Plaintiff agreed. Upon return, officer Rittenhouse asked to use the Plaintiff's bathroom and they all entered the house. When officer Rittenhouse exited the bathroom, the Plaintiff noticed there was vomit and urine all over the bathroom and had to clean it. Afterwards, officer Rittenhouse questioned the Plaintiff about a certain vape pen that was on the kitchen table and the Plaintiff explained that it was CBD. Officer Rittenhouse demanded that 911 be called. When the officers exited the house, rather than call 911, officer Philbin called officer Michael Geniale who was a friend. When officer Geniale arrived, officers Philbin and Rittenhouse told him that Rittenhouse was slipped weed at the Nautical Mile at a bar, where officer Rittenhouse inhaled a puff of a vape pen that belonged to a stranger and experienced a reaction. Officer Geniale called Sergeant Roe who directed Geniale to tell officers Rittenhouse and Philbin to call 911, request an ambulance and go to the hospital. Contrary to departmental policies, neither officer documented the aided call via an incident or unusual incident report. Officers Rittenhouse and Philbin called 911 and officer Vincent Falzone responded to officer Philbin's home. A Nassau County Police Department (NCDP) Emergency Ambulance Bureau ambulance was also dispatched to officer Philbin's home. \n\nOn June 16, 2018, officer Rittenhouse was transported to Southside Nassau Community Hospital where he tested positive for THC. At this point, the officers conspired and fabricated a different story for what had happened in order to protect officer Rittenhouse's employment with the City of New York in the New York Police Department. The other officers aided and abetted officer Rittenhouse in fabricating a new narrative and accuse the Plaintiff of wrongdoing through filing false police reports, and withholding exculpatory evidence during the course of the criminal prosecution of the Plaintiff. \n\nOn June 17, 2018, officers Geniale, Gene Hall, Lawrence Horne, Kennedy, Geniale, and ten more unknown unlawfully entered the Plaintiff's home, and arrested him, and took him to Village of Freeport Police Department (VFPD) headquarters where he was searched, processed and questioned without being informed of his rights. The Plaintiff was then transported to the Nassau County Police Department (NCPD) headquarters where he was further processed and detained until arraignment the next day. The Plaintiff was charged with assault in the 2nd degree. Officer Hall signed the accusatory instrument for the prosecution with no evidence offered to substantiate the charges. In fact, the officers were aware that that officers Geniale and Falzone had responded to the scene and both were provided with a different story by officers Rittenhouse and Philbin than what was reported. Moreover, district attorney Madeline Singas and ten more unknown officers failed to disclose that officers Geniale and Falzone were witnesses and failed to provide a copy of Falzone's Aided Report in violation of the Plaintiff's rights. Further, the Plaintiff was forced to accept an ACD on January 2, 2019, threatened with continued prosecution by the Nassau County district attorney Singas and other officers. As a result of the malicious prosecution, the Plaintiff incurred substantial legal costs and the information about his prosecution was intentionally released to the public. \n\nIn late June 2018, the Plaintiff filed a civilian complaint with VFPD internal affairs and NYPD internal affairs. NYPD assigned detectives O'Houche and Garcia to investigate whereas the VFPD assigned detective Vincent Kennedy.
