The officers then took the plaintiffs to an NYPD precinct where they were subjected to further illegal searches, interrogations, and scans. At the precinct, Defendant Officer John Doe made sexual remarks to Plaintiff Hernandez while other officers smirked and failed to intervene. The plaintiffs were detained at the precinct for approximately 8.5 hours before being taken to NY County Central Booking. Due to the mistreatment, Plaintiff Kemely Vega required medication and was taken to NY Downtown Hospital while remaining handcuffed. After spending the night in central booking, the plaintiffs were released on March 5, 2022, after about 26 hours in NYPD custody, when the district attorney's office declined to prosecute their case. After finally granting her repeated requests to use the restroom, a male officer stood and watched her while she was entirely exposed to him. They took her to the 30th precinct; she complained she wasn't feeling well; her blood pressure was so high that she had to be rushed to the hospital. The officers informed her while she was in the hospital that the charges were dropped and refused to help her find her way home despite taking her money, phone, and metro card. The third plaintiff is the son of the first two plaintiffs. He was asleep in bed when five unidentified officers entered his bedroom with their guns drawn. Defendants applied handcuffs to Plaintiff in an excessively forceful and tight fashion. upon arriving at the precinct, Defendants conducted or authorized an illegal strip search and cavity inspection of Plaintiff. Defendant Bonifacio signed the accusatory instrument, and Defendants all gave knowingly and intentionally false, misleading, or incomplete information to the DA's office that Plaintiff was in possession of an illicit air pistol that duplicated a real firearm.
