The defendants had no probable cause or reasonable suspicion that the plaintiff was engaged in an illegal activity. The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants used excessive force in effectuating the arrest and repeatedly struck Plaintiff about the face and body causing significant injuries to him. Plaintiff was transported to the 120th precinct. While Plaintiff was in the custody of the defendants at the precinct, Defendants prepared and filed false paperwork with the DA alleging that they had observed plaintiff committing various crimes/offenses. As a result, the plaintiff was transported to Central Booking where he was incarcerated until he was released from defendant’s custody.
