Plaintiff Johnson responded by speeding up and passing Defendant Detective Wallace’s car; she responded by pulling even with Plaintiff and they began to shout at each other. Plaintiff Johnson pulled over and Defendant Detective Wallace pulled over behind him. They approached each other and were speaking when Defendant Detective Wallace struck Plaintiff Johnson in the neck with her hand. She then drew her firearm and hit Plaintiff Johnson in the neck with the handle of the gun. Only then did Detective Wallace identify herself as a police officer. Plaintiff Johnson’s girlfriend called 911 and Defendant Detective Wallace attempted to flee but was unable to do so. Police officer arrived at the scene and Johnson, his passengers, and Wallace were taken into the precinct. While at the precinct, Plaintiff Johnson asked if he could leave and Defendant Captain John Potkay yelled at him to stop asking; when Plaintiff Johnson responded, Defendant Potkay ordered Defendant Officer Joseph Tortora to arrest Johnson. Defendant Officer Tau Samuel then made a criminal complaint and arrest report in reliance on Defendant Detective Wallace’s statements despite Plaintiff Johnson’s, his girlfriend’s, his other passenger’s, and an unrelated eyewitness’s statements. Plaintiff Johnson was charged with felony assault of a police officer while Defendant Wallace was charged with nothing. Plaintiff Johnson then received medical treatment for his neck, where he was diagnosed with muscle spasms.
