These officers were in possession of a search warrant that had been obtained through false information -- Castillo, Gallitelli, Rivera, & Green had falsely informed the DAO & judicial officer that a confidential informant had provided them with credible information to justify the warrant (that Plaintiff was selling heroin from that location). The Defendant officers entered the apartment with their guns drawn, shoved Plaintiff to the floor, and handcuffed Plaintiff with excessive tightness, causing bruising. They searched Plaintiff, yielding nothing, and searched the residence, finding two oxycodone pills that the apartment's legal resident had obtained via medical prescription -- a fact of which they were immediately informed by the apartment's resident, who showed them the prescription. Despite this, Plaintiff was arrested for Criminal Possession of a Controlled Substance and held in the precinct for 8 hours before being released & issued a Desk Appearance Ticket. The aforementioned Defendants falsely informed the DAO that the two oxycodone pills were in Plaintiff's possession in order to initiate prosecution. Plaintiff accepted an ACD on November 2, 2017, and the charge was dismissed on May 1, 2018. Plaintiff believes that these actions against him were taken in retaliation for his then-pending lawsuit against the NYPD & Defendant Valentin (Index No. 306154-2014) and specifically to prevent Plaintiff \"from attending his scheduled court appearance for the day of his arrest and cause a bench warrant to be issued\".","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.521001/gov.uscourts.nysd.521001.20.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/16052587/peralta-v-city-of-new-york/"},{"name":"Smith, Jerome, et al. vs City of New York, et al.","start_date":"2017-10-24","disposition_date":"2020-07-07","payout_amount":18000,"disposition":"Settlement","docket":"159391/2017","court":"Supreme Court - New York","officer_name":"Castillo, Daniel","summary":"On January 22, 2016, at approximately 6:00 a.m., Jerome Smith and Alexander Davidson were inside their residence at 2102 Madison Avenue in Manhattan when Detectives Daniel Castillo, Charne Jimenez, and other NYPD officers entered without a warrant or legal justification. The officers conducted a search but found no evidence of any criminal activity. Despite this, the plaintiffs were handcuffed, detained, and transported to a precinct. Detectives Castillo and Jimenez later swore out false criminal complaints alleging that the plaintiffs possessed marijuana, a fake gun, and ammunition. The plaintiffs were held in custody for several hours before being arraigned. The charges against Mr. Smith were dismissed on December 2, 2016, and those against Mr. Davidson were dismissed on November 15, 2016.
