Prior to the arrest, the plaintiff waited in line to enter the T-Mobile store, following all COVID-19 protocols and procedures. Shortly after, Jane Doe, a store employee, called patrons who stood behind the plaintiff to enter the store and refused the plaintiff entry, making anti-Semitic comments. Eventually, the plaintiff entered the store, but Jane Doe continued to harass him and even locked the store's door to prevent him from leaving. The plaintiff was effectively imprisoned by the employee, so he called the police. When the police arrived, the plaintiff informed them of what had happened. However, despite checking the surveillance video and hearing the plaintiff's account, the defendants placed the plaintiff in handcuffs, made anti-Semitic comments in a threatening and harassing manner, and arrested him. Defendants who were present but not physically involved failed to intervene. The plaintiff was taken to a police precinct where he spent an extended period before being released with a desk appearance ticket. The defendants ignored all the facts and evidence and falsely accused the plaintiff of committing various crimes.
